Most calculators rely on simplified inputs (age, income, dependents). That’s not how insurers actually evaluate risk.
In Virginia wrongful death matters, settlement value is strongly shaped by:
- What proof exists for fault (police findings, witness accounts, surveillance, incident reports)
- How clearly the death is tied to the incident (medical records and causation)
- Whether the decedent’s conduct could reduce recovery (comparative responsibility is a real factor in many cases)
- How damages are documented (funeral/burial costs, lost financial support, and other losses tied to the relationship)
- Insurance coverage and policy limits available to pay a settlement
When those elements aren’t built into the “calculation,” the estimate can be misleading—sometimes by a lot.
