Many calculators assume that the “story” of the death is already established. In real Jerome wrongful death cases, the hard part is usually proving one or more of the following:
- Who was responsible for the fatal incident (and whether Idaho’s comparative fault rules reduce recovery)
- How the incident caused the death (sometimes the defense argues an existing condition or intervening factors)
- What damages are actually supported with records—not just estimates
Two families can enter similar information into a calculator and still end up with very different outcomes because the evidence quality and liability theory are different.
