Most online tools use simplified assumptions—like how long you were hospitalized or whether you had certain diagnostic testing. Real cases are messier.
In TBI claims, insurers often focus on questions like:
- Did you receive timely evaluation after the head injury?
- Do the clinical notes track your symptoms (headaches, dizziness, memory problems, mood changes) consistently?
- Do you have work restrictions, therapy records, or follow-up testing that show ongoing functional limits?
- Is there evidence the injury was caused by the specific incident—not an earlier condition or another event?
A calculator can’t account for how these issues are argued in real negotiations, or how Tennessee courts expect evidence to line up.
