Injuries involving the brain can be difficult for insurers to evaluate because imaging doesn’t always show what you’re experiencing—especially with concussions and other closed-head injuries.
In practice, your settlement value usually rises or falls based on questions like:
- Did you receive prompt medical evaluation after the incident?
- Are your symptoms described in a way that connects to the accident (head impact, acceleration/deceleration forces, fall, or blow)?
- Is there documentation of how the injury affects daily functioning—work performance, concentration, sleep, mood, driving, and safety?
- Are your records consistent over time, including follow-up visits and treatment compliance?
A calculator may not “see” those details. That’s why two people with similar diagnoses can end up with very different results.
