In the days after a resident falls, the most helpful actions are usually the least “legal-sounding,” but they protect both the person’s health and your ability to investigate later.
Do these early steps:
- Request a same-day medical evaluation if there’s any head strike, severe pain, dizziness, or sudden change in mobility.
- Ask for the incident report and nursing notes as soon as possible (and keep copies).
- Track a simple timeline: time of fall, who was present, what staff said, when symptoms appeared, and what treatment followed.
- Preserve fall-related items when allowed (e.g., footwear, mobility aids, transfer devices) and note the resident’s location in the facility.
In New Jersey, delays or gaps in documentation can matter. The earlier you document what happened and what the facility recorded, the stronger the foundation for any claim.
