What you do right after the incident can affect both the resident’s care and the strength of a potential claim.
- Get medical evaluation immediately. Even “minor” head bumps can require observation.
- Ask for the incident details in writing (time, location, who was present, what assistance was provided, and what the staff did afterward).
- Request copies of key records through the facility’s process—especially nursing notes, fall documentation, and the resident’s care plan.
- Write down what you learn while it’s fresh: what staff said, what you observed, and whether the resident had new symptoms (confusion, dizziness, swelling, increased pain).
If you’re contacted by the facility or insurer, consider getting legal guidance before providing a recorded statement. Early communication can be used later to minimize what occurred.
