In practice, Texas insurers and defense counsel focus heavily on:
- Whether the provider breached the standard of care (what a reasonably careful provider would have done)
- Whether that breach caused your specific harm
- How well the medical record supports the timeline
- Whether future treatment and limitations are documented
A calculator can’t review imaging, operative reports, nursing notes, consults, or the inconsistencies that sometimes appear between what was communicated and what was charted.
