Most online malpractice settlement calculators work like this: you enter injury details and medical costs, and the tool outputs an estimated range.
The problem is that malpractice settlements don’t hinge on symptoms alone. In North Carolina, settlement leverage usually turns on whether you can prove:
- The standard of care was breached (what a reasonably careful provider should have done)
- That breach caused the harm (not just that you were injured)
- The damages are supported by records (treatment history, follow-up care, and expenses)
If a calculator assumes the case is straightforward, it may produce a range that doesn’t reflect the real disputes insurers focus on—such as causation, documentation gaps, or whether later treatment broke the link between the alleged error and your condition.
