However, these calculators often can’t account for the factors that most strongly drive outcomes in California malpractice disputes, such as:
- whether the medical team’s actions fell below the required standard of care
- whether the harm was actually caused by the alleged mistake (and not an unavoidable progression)
- how clean the medical documentation is (charts, imaging reports, medication records, consent forms)
- whether experts can explain the medical connection in a way a jury would understand
In other words, the “number” you see online may reflect assumptions that don’t match what your records show.
