Even when the bite seems obvious, insurers may argue over:
- Whether the dog was controlled (leashed or properly contained)
- Whether the injured person was lawfully present on the property
- Whether the bite was foreseeable (for example, the owner knew about prior aggressive behavior)
- Causation—they may question whether the injury is consistent with the account of the incident
In a suburban community like ours, it’s common for witnesses to be neighbors, delivery drivers, or family members—people who may not realize they can later be asked to clarify what they saw. Small inconsistencies between witness accounts and medical records can become a major issue during negotiations.
