But settlement outcomes in California usually hinge on details that aren’t “captured” by a typical form:
- How quickly your symptoms were reported and how consistently they appear in early medical notes
- Whether work restrictions were documented in a way an insurer can’t easily minimize
- Whether your job duties match the restrictions (especially in physically active roles common in the area)
- The timing of treatment—whether there are gaps that the defense may label as non-credible or unrelated
- Wage proof and job classification, including how your pay was actually structured during the relevant period
In other words, the estimate may look reasonable while still overlooking the issues that decide whether the insurer negotiates fairly.
