- Get evaluated promptly, even if symptoms seem minor at first. Head injuries, chemical irritation, and near-drowning complications can worsen.
- Document what you can immediately: photos of the deck surface, ladders, gates, signage, and any visible defects.
- Record the timeline (what happened, who was present, weather/lighting conditions, and how long the hazard may have been there).
- Ask for incident reports and maintenance/service records from the property manager or operator.
If you’re contacted by an insurance adjuster, don’t feel pressured to give a recorded statement before speaking with a lawyer. Early comments can be used to reduce or deny claims.
