In the hours after a pool incident, what you do (and what you don’t do) can strongly affect your claim.
- Get medical care right away—especially for head injury, breathing trouble, or any near-drowning symptoms.
- Request that the scene be documented: take photos if you can safely do so (deck condition, lighting, barriers/gates, drain covers, ladders/handrails).
- Preserve any pool access and safety setup (barrier condition, gate latch function, signage, cover/alarms) before it’s repaired or removed.
- Write down a timeline while memories are fresh—what was happening, who was present, weather/lighting conditions, and when symptoms began.
- Be careful with statements to property staff or insurance. Early comments can be used to minimize fault.
If the incident happened at a rental or community pool, ask for incident reports and maintenance records—those documents often become harder to obtain later.
