Before you worry about blame, focus on a clean record and safe care. In California, early documentation can strongly affect how insurers and defense counsel evaluate causation.
- Get medical care right away (especially for head injuries, breathing problems, near-drowning symptoms, or chemical exposure).
- Report the incident to the property manager/owner in writing as soon as possible.
- Document the scene if you can do so safely: deck conditions, broken or missing safety features, gate operation, warning signs, and any visible water-related issues.
- Preserve evidence: ask the responsible party to preserve surveillance footage and maintenance records.
- Avoid recorded statements to adjusters until you’ve spoken with an attorney.
