A recall is an important public safety action, but it doesn’t automatically settle your situation. For your claim to move forward, you still generally have to show:
- the product you used was actually part of the recall scope,
- the safety defect (or missing warning) was present when you were injured,
- the defect caused or contributed to your harm,
- and the damages you’re claiming match the injuries and treatment you received.
That’s especially true in Texas, where insurers commonly challenge causation and may argue the injury came from something else—like installation problems, improper maintenance, modifications, or use outside instructions.
