In a coastal city with year-round foot traffic, drivers aren’t always expecting pedestrians at the same places they would in more suburban areas. Santa Cruz also has:
- High tourist activity (people not as familiar with traffic patterns)
- Bike + pedestrian overlap in certain areas and corridors
- Frequent turning movements where drivers must watch for people near curb lines
- Lighting and visibility challenges (fog, glare, sunset hours, and uneven street illumination)
- Construction and road changes that can affect sightlines and signage
Even if you believe the driver “obviously” caused the crash, insurers may still argue that the pedestrian stepped into the roadway late, that signage was unclear, or that you should have seen the vehicle sooner. Your evidence needs to be ready for those arguments.
