If you’re physically able, your priority is medical care. After that, the most important “legal” step is evidence preservation—because scenes in San Jose change fast.
Do what you can, safely:
- Photograph the roadway: crosswalks or marked crossings, lane lines, curb ramps, lighting, and any obstructions (parked cars, construction barriers, vegetation).
- Capture vehicle details: license plate, make/model/color, and the point of impact.
- Write down what you remember immediately—signal phases, whether the driver yielded, traffic speed, and what you saw right before impact.
- Identify witnesses in the moment (people near transit stops, nearby businesses, or drivers who saw the collision).
If a driver or bystander suggests “just exchange info and be done,” be cautious. In the Bay Area, even seemingly minor collisions can involve delayed symptoms. A prompt medical visit can also help establish a reliable record.
