After a fall, the next day or two can determine what evidence is available later. If you can, prioritize:
- Get medical attention immediately (and make sure injuries are documented). Even “minor” falls can lead to delayed symptoms.
- Ask for the incident report and fall documentation while the details are fresh.
- Request preservation of video and electronic logs (if the facility uses cameras or electronic monitoring). Ask them to preserve relevant footage connected to the time of the fall.
- Write down what you observe and what staff say—including where the resident was, what they were doing, what assistive devices were used, and how staff responded.
- Keep copies of every document you receive and note dates of requests.
Ohio nursing home litigation can turn on timing and documentation. Acting early helps prevent gaps that can make it harder to prove what the facility knew and what it did.
