The fastest way to protect your claim is to act early—before records get incomplete or surveillance is overwritten.
**Ask the facility (in writing, if possible) for: **
- The incident report and any “unusual occurrence” documentation
- The resident’s fall risk assessment and the care plan section addressing mobility/transfer needs
- The shift notes for the hours before and after the fall
- Medication administration records around the fall time (sedatives, pain meds, or recent changes can be relevant)
- A record of what staff observed and what they did immediately after the fall
- Whether alarms, bed/chair positioning, or walker use were in place—and whether they were followed
- If video may exist, a request that the facility preserves surveillance
If you’re unsure what to request, we can help you generate a focused document list for your Lockport nursing home case.
