- the type of injury and treatment timeline
- medical bills and recovery duration
- whether the harm appears temporary or permanent
- reported limits on work, daily activities, or mobility
That can be useful as a starting point. But it’s not a substitute for a legal evaluation because malpractice value is driven by what can be proven—not just what happened.
In California, insurers and defense counsel will look closely at whether there was a breach of the standard of care and whether that breach caused the injury. Those questions require medical records and, often, expert review.
