Many drunk driving cases start with something that feels “obvious” to victims—someone was impaired, someone crossed the line, someone ran a stop or failed to slow down. But in Texas, insurance and defense teams frequently contest the details:
- Which lane the vehicles were in before impact
- Whether the impaired driving was the cause of the collision (versus speed, weather, or road design)
- What the testing results actually prove (and whether procedures were followed)
- When witnesses saw what they saw
Even if the driver is arrested, the civil injury claim still turns on evidence and credibility. A “fast answer” is not the same as a strong case.
