After a crash, insurers often steer the conversation toward “the crash was the cause” and argue the restraint performed normally. But in restraint-failure cases, the details matter:
- Whether the belt locked when it should
- Whether there was abnormal slack
- Whether the retractor behaved inconsistently
- Whether the belt system shows signs of malfunction
Ohio claims are also time-sensitive. Like other injury cases, product liability and negligence-based claims generally fall under Ohio’s statute of limitations, and deadlines can be affected by when you discovered (or reasonably should have discovered) the problem.
