After a device-related complication, your priority is medical safety. But the first few days also determine how strong your case can be later.
Consider doing the following right away:
- Request your device information: Ask your clinician for the device name, model, lot/batch number, and any implantation paperwork.
- Keep a “timeline” folder: Save discharge paperwork, operative/procedure reports, follow-up visit notes, imaging reports, and lab results.
- Document symptoms while they’re fresh: Note when symptoms started, how they progressed, and what treatments were tried.
- Don’t give a recorded statement to insurers: Early statements can be used later to narrow or deny causation.
Because California injury claims are time-sensitive, early organization is often the difference between a smooth investigation and a messy one.
