In the days after a serious injury, insurance representatives may try to move quickly. In Massachusetts, that doesn’t always mean you should respond quickly.
Focus on these basics:
- Get medical care immediately and follow discharge instructions. Catastrophic cases often turn on medical documentation.
- Write down the incident while it’s fresh—where you were, what you saw/heard, weather/lighting, traffic conditions, and any hazards.
- Keep every paper trail: ER paperwork, discharge summaries, specialist notes, medication lists, and receipts for out-of-pocket costs.
- Preserve evidence you can access (photos of the scene, visible injuries, and anything that shows the conditions that caused the harm).
Be cautious with statements. Recorded or written statements can be used to argue the injury is less serious, unrelated, or temporary. If you’re unsure what to say, it’s often safer to pause and get legal guidance first.
