In a city with heavy commuter routes and streets that blend residential, retail, and through-traffic, fault disputes are common. The other side may claim:
- you were “out of position” or riding too fast for conditions,
- the driver had a limited view (turning, passing, or merging),
- the crash was caused by roadway factors (“they had to avoid you”), or
- your injuries were not caused by the collision.
Massachusetts claims can also get complicated by comparative negligence—meaning your compensation may be reduced if you’re found partially at fault. The good news: even partial fault doesn’t automatically kill a claim. The outcome depends on how the evidence fits together.
